Please read these Terms and Conditions (“Terms“) carefully before using SendTheSong (sendthesong.id, the “Service“). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Overview

SendTheSong is a platform that allows users to create and share messages paired with a song, either anonymously or with attribution, and to search for messages addressed to them.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian.

3. Your Account and Content

  • You do not need to register an account to use core features of the Service, unless otherwise stated.
  • Any message, name, or content you submit (“User Content“) remains your responsibility. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content through the Service.
  • You represent that you have the right to submit the User Content and that it does not violate any third party’s rights.

4. Acceptable Use

You agree not to use the Service to:

  • Harass, threaten, defame, stalk, or bully any person.
  • Post content that is unlawful, obscene, hateful, discriminatory, sexually explicit, or exploitative, especially content involving minors.
  • Impersonate any person or entity, or misrepresent your affiliation with someone.
  • Upload or transmit viruses, malware, or other harmful code.
  • Attempt to gain unauthorized access to the Service, other users’ data, or our systems.
  • Scrape, harvest, or misuse data available through the Service, including names or messages, for purposes unrelated to normal use.
  • Use the Service for spam, phishing, or any illegal activity.

We reserve the right to remove content and suspend or terminate access for users who violate these Terms.

5. Anonymous Messaging Disclaimer

  • The Service allows anonymous message submission. We do not verify the identity of senders.
  • Because messages may be anonymous, we cannot guarantee the accuracy, intent, or truthfulness of any message.
  • We are not responsible for emotional distress, reputational harm, or other consequences arising from messages sent or received through the Service.
  • If you receive a message that you believe violates these Terms (e.g., harassment or threats), please report it to us at contact@sendthesong.id.

6. Songs and Third-Party Content

  • Songs featured, linked, or embedded on the Service are the property of their respective rights holders (artists, labels, publishers, and streaming platforms).
  • We do not claim ownership of any song and do not host unauthorized copies of copyrighted audio. Playback may be provided via licensed third-party embeds or streaming links, subject to those platforms’ own terms.
  • If you believe content on the Service infringes your copyright, contact us at contact@sendthesong.id with details of the alleged infringement, and we will investigate and take appropriate action.

7. Intellectual Property

  • The Service’s design, branding, logos, and underlying software are owned by us or our licensors and are protected by intellectual property laws.
  • You may not copy, modify, distribute, or create derivative works from the Service itself without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect information. By using the Service, you consent to those practices.

9. Disclaimers

  • The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure.
  • We are not responsible for the content, accuracy, or opinions expressed in User Content, which reflects the views of the individual submitter, not the Platform.

10. Limitation of Liability

To the fullest extent permitted by applicable law, SendTheSong and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or emotional distress, arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless SendTheSong and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service, other users, or third parties.

13. Changes to the Service and Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; material changes will be indicated by updating the “Last updated” date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Indonesia, unless otherwise required by applicable law.
